GymJoin terms of service

These Terms of Service are a legally binding agreement between you and GymJoin that governs your use of the GymJoin platform — the mobile app and this website. They are written in plain language, but they are a real contract under the laws of Ukraine, so please read them before you start using the service.

1. What these terms are

These terms constitute a public offer within the meaning of Articles 633, 641, and 642 of the Civil Code of Ukraine and an electronic contract under the Law of Ukraine "On Electronic Commerce" No. 675-VIII. By registering an account or otherwise using GymJoin, you accept this offer in full and without reservations — this has the same legal force as a signed paper contract. If you do not agree with any part of these terms, please do not use the service. The Ukrainian version of these terms prevails if the translations ever diverge.

2. Who can use GymJoin

To keep the platform safe and legally sound, we ask that:

  • You are at least 14 years old. Users aged 14–18 may use GymJoin only with the consent of a parent or legal guardian, in line with the rules on civil capacity of minors in Articles 31–32 of the Civil Code of Ukraine.
  • You provide accurate, current information when registering — whether you sign up as an athlete, a private coach, a gym, or an administrator — and keep it up to date.
  • You register a gym or coach profile only if you are genuinely authorised to act on behalf of that gym or offer coaching services.
  • You keep your sign-in credentials and one-time codes to yourself. Everything done through your account is treated as done by you, so tell us immediately if you suspect unauthorised access.
  • You maintain one personal account. Duplicate or fake accounts may be removed.

3. What GymJoin is — and what it is not

GymJoin is a technology platform that helps athletes discover gyms, private coaches, and trainings, subscribe to them, and track attendance — and helps gyms and coaches manage their schedules, clients, and statistics. GymJoin itself does not provide training services. When you subscribe to a gym, coach, or training, the actual training relationship — including its quality, safety, price, and any membership terms — arises directly between you and that gym or coach. GymJoin acts as an intermediary information service within the meaning of the Law of Ukraine "On Electronic Commerce" and is not a party to that relationship.

4. Subscriptions, bookings, and check-ins

  • Sending a subscription or booking request does not guarantee a spot: a request becomes a confirmed subscription only after the gym, coach, or their administrator accepts it.
  • Gyms and coaches decide for themselves whom to accept and may decline requests, provided they do not discriminate on grounds prohibited by Ukrainian law.
  • Check-ins and attendance are confirmed by the gym, coach, or administrator. If you believe an attendance or payment record is wrong, raise it first with the gym or coach; our support team can help if you cannot resolve it.
  • Schedules, prices, and training details shown on the platform are published by gyms and coaches themselves and may change; the gym or coach is responsible for keeping them accurate.

5. Payments and pricing

Using the GymJoin app and website is currently free for athletes. Payments for trainings and memberships are made directly between you and the gym or coach (for example, in cash or by bank transfer), and the platform only records payment confirmations entered by the gym, coach, or administrator — we do not process the money and do not store card numbers. Any paid relationship between you and a gym or coach is protected by the Law of Ukraine "On Protection of Consumer Rights" No. 1023-XII. When in-app payments are introduced, they will be processed by a licensed payment service provider in accordance with the Law of Ukraine "On Payment Services" No. 1591-IX, and we will update these terms and notify you before launch.

6. For gyms, coaches, and administrators

If you use GymJoin as a gym, private coach, or administrator, you additionally undertake to:

  • conduct your activity lawfully — including any state registration as a business entity or independent professional and the payment of taxes required by Ukrainian law; GymJoin is not your employer, agent, or tax agent;
  • publish only accurate schedules, prices, sport types, and venue details, and honour the offers you publish, as required by the consumer-protection rules on fair information (Articles 15 and 19 of Law No. 1023-XII);
  • comply with safety, sanitary, and other requirements that apply to your venue and your training activity, and hold any permits or qualifications your sport requires;
  • treat visitor data you see on the platform (names, attendance, contact details) as confidential, use it only to manage your trainings, and never export or reuse it for marketing without the person’s own consent — as required by the Law of Ukraine "On Personal Data Protection" No. 2297-VI;
  • resolve disputes with your clients in good faith; repeated well-founded complaints may lead to suspension of your profile.

7. Reviews and your content

You keep ownership of everything you post on GymJoin — reviews, ratings, photos, and profile information. By posting it, you grant GymJoin a free, non-exclusive licence to host, display, and reproduce that content within the service (including in public gym and coach profiles and in search results) for as long as it stays published. Reviews must reflect your genuine experience: fake, paid-for, defamatory, or retaliatory reviews are removed. We may moderate, restrict, or delete content that violates these terms or Ukrainian law, and we will explain the reason when we do.

8. Acceptable use

When using GymJoin, you must not:

  • break the law of Ukraine or the rights of others, including privacy and intellectual property rights;
  • impersonate another person, gym, or coach, or misrepresent your affiliation with anyone;
  • post content that is unlawful, defamatory, threatening, pornographic, or that incites hatred or violence;
  • scrape, harvest, or mass-download data from the platform, or access it by automated means other than public search engines;
  • interfere with the operation or security of the service — for example, by probing vulnerabilities, distributing malware, or circumventing access controls;
  • use the platform to send spam or unsolicited advertising.

We may suspend or terminate accounts that violate these rules, as described in the "Suspension and termination" section.

9. Intellectual property

The GymJoin name, logo, app, website, design, and software are protected by the Law of Ukraine "On Copyright and Related Rights" No. 2811-IX and other intellectual property legislation, and belong to GymJoin or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the app and website for their intended purpose. You may not copy, modify, decompile, resell, or create derivative works from the service, except where Ukrainian law expressly permits it.

10. Health and safety

Sport involves physical exertion and inherent risk. You participate in trainings voluntarily and at your own assessment of your health; if you have any doubts, consult a doctor before starting. Responsibility for safe training conditions — the venue, the equipment, and the conduct of the session — lies with the gym or coach that runs it, in accordance with Ukrainian law. GymJoin does not verify medical fitness and information on the platform is not medical advice.

11. Personal data

We process your personal data in accordance with the Law of Ukraine "On Personal Data Protection" No. 2297-VI and, where applicable, the GDPR. How and why we do it — and the rights you have — is described in our Privacy Policy, which forms an integral part of these terms.

12. Our liability

We work hard to keep GymJoin available and accurate, but the service is provided "as is" to the extent Ukrainian law allows. In particular:

  • GymJoin is not liable for the actions of gyms, coaches, administrators, or other users, for the quality or safety of trainings, or for the accuracy of schedules and prices they publish;
  • we are not liable for temporary unavailability caused by maintenance, faults of communication providers, or force majeure (including war, missile strikes, and power outages, as certified in the manner established by Ukrainian law);
  • our total liability to you for any claim connected with the service is limited to the amount you paid GymJoin for it in the 12 months before the claim (currently: zero for free use), except where the harm was caused intentionally or by gross negligence.

Nothing in these terms limits the rights you have as a consumer under the Law of Ukraine "On Protection of Consumer Rights" or any other rights that cannot be waived by contract.

13. Suspension and termination

You may stop using GymJoin and delete your account at any time in the app under Profile → My details; deletion is handled as described in the Privacy Policy. We may suspend or terminate an account that seriously or repeatedly violates these terms, that we are required to block by law, or that shows signs of fraud or a security compromise. Unless the violation makes it impossible, we will warn you and give you a chance to respond before terminating, and you may appeal any suspension by contacting support. Sections of these terms that by their nature should survive termination (content licences, liability, disputes) remain in force.

14. Governing law and disputes

These terms are governed by the law of Ukraine. If a dispute arises, please contact us first — most issues are resolved by our support team within a few days. If we cannot resolve it amicably, the dispute is settled by the courts of Ukraine under its procedural law: as a consumer you may, under the Civil Procedure Code of Ukraine, bring a claim at your own place of residence, and you may also complain to the State Service of Ukraine on Food Safety and Consumer Protection or the Ukrainian Parliament Commissioner for Human Rights (for data matters). If any provision of these terms is held invalid, the rest remain in force.

15. Changes to these terms

We may update these terms as GymJoin evolves — for example, when we launch in-app payments, messaging, or online trainings. When we do, we will update the version and effective date above and notify you in the app or on this website before significant changes take effect, in line with the Law of Ukraine "On Electronic Commerce". If you continue using the service after the new version takes effect, the updated terms apply; if you do not agree with them, you may stop using the service and delete your account.
